Client intake structuring. AI processes intake interview notes into structured case files. Useful, but misses the silent context (what the client emphasized, what they avoided, the look they gave when discussing their business partner). Senior intake still adds value here.
Discovery search-term generation. AI produces search-term lists for ESI discovery. Useful starting point. The terms it misses are usually domain-specific jargon — and junior lawyers who've worked the matter catch those.
Argument stress-testing. Steelmanning your opponent's position. AI does this competently but lacks the strategic judgment about which counter-arguments your specific opponent will actually use. Senior litigation associates still beat AI on opponent prediction.
Low-reliability uses (AI is mostly decorative or actively harmful)
Strategic case theory development. AI generates plausible-sounding case theories that lack the strategic coherence that comes from understanding the specific judge, opposing counsel, jury pool, and political climate. We've seen at least three filings in 2025-2026 where AI-generated case theories tracked perfectly with general legal logic and got destroyed at trial because they ignored specific contextual factors.
Client communication. AI-written client emails are detectable. Clients who notice (and many notice) report decreased trust. The math doesn't work — saving 4 minutes by AI-drafting an email costs 40 minutes recovering trust later.
Negotiation strategy. AI can outline negotiation positions, but cannot read the room. Used as a coaching tool: helpful. Used as a script: career-limiting.
Witness preparation. AI-generated direct-examination outlines miss the human factors (witness anxiety patterns, the specific way your witness gets defensive) that determine whether testimony lands.
What AI hasn't changed (and probably won't)
Three categories of legal work appear durably resistant to AI displacement:
- Client trust and relationship work. When a CEO calls their lawyer at 11 PM during a crisis, they're not paying for legal research output. They're paying for the relationship and the human judgment of someone who knows their company.

Solo lawyers can produce sophisticated brief structures. What used to require a 4-person team in a mid-sized firm can now be done by 1 lawyer + AI + 1 paralegal.
